1. Agreement
These Terms of Service govern your use of the Direct Mail Results website and your purchase of envelope kits, supplies, or done-for-you campaign services ("Services") from Direct Mail Results ("we," "us"). By placing an order, booking a call, or engaging our Services, you agree to these terms.
2. Products and services
We offer two types of offerings: (a) physical direct-mail supplies, such as urgent-delivery envelope kits, sold directly through this website; and (b) done-for-you direct-mail campaign services, such as the Empty Chair Recovery System, which are scoped and delivered as described on the relevant service page and confirmed with you before work begins.
3. Pricing and payment
Prices for supplies are listed on each product page in Canadian dollars. Prices for campaign services are as listed on the relevant service page or as quoted directly to you, and are due according to the payment terms confirmed at the time of booking. We reserve the right to correct pricing errors.
4. Campaign services — scope and timelines
Done-for-you campaign services are delivered according to the scope, patient/customer counts, and mail-touch sequence described for the tier you purchase. Timelines depend on receipt of a usable list export from you and any required approvals. Delays caused by late list delivery or slow approval turnaround may extend the campaign timeline accordingly.
5. The 12-Booking Guarantee
Where a campaign is covered by the 12-Booking Guarantee, its terms are as described on our Our Guarantee page at the time of purchase. The guarantee applies to campaigns delivered as scoped and does not apply where a client declines the operational consultation or fails to act on patient/customer responses generated by the campaign.
6. Your responsibilities
- Providing an accurate, appropriately consented patient, customer, or prospect list for mailing
- Complying with applicable privacy and anti-spam law with respect to the list you provide us
- Participating in the operational consultation prior to campaign launch
- Providing timely feedback and approvals during the production process
7. Cancellations
Physical product orders may be cancelled prior to shipment for a full refund. Once a campaign service has entered production (design, printing, or mailing), cancellation terms are as agreed in your service confirmation; hard costs already incurred (printing, postage) are generally non-refundable.
8. Intellectual property
Mail piece designs, copy frameworks, and diagnostic methodology developed by Direct Mail Results remain our intellectual property. You receive a license to use materials produced specifically for your campaign for your own business purposes.
9. Limitation of liability
Except as expressly set out in a written guarantee, our Services are provided without warranties of specific results beyond those guarantee terms. To the fullest extent permitted by law, our liability for any claim relating to the Services is limited to the amount you paid us for the Services giving rise to the claim.
10. Governing law
These terms are governed by the laws of Canada and the applicable province, without regard to conflict-of-law principles.
11. Changes to these terms
We may update these terms from time to time. Continued use of our website or Services after changes are posted constitutes acceptance of the updated terms.
